Landmark Judgment for F&F Litigation Partner

Today, a landmark judgment was given wherein the Court of Appeal dismissed the Appelli del terzo of Collis Williams Limited et and the Kamra tal-Ispizjara, and the cross appeal of the Superintendent of Public Health was declared null and void.
Dr. Edward DeBono, Partner in the Dispute Resolution & Litigation department has secured for his client, Mr Reginald Fava, for and on behalf of Chemimart Limited the right to relocate his pharmacy from 3 Freedom Square Valletta to 20/21 Republic Street, Valletta. Therefore the judgment of the First Hall of the Civil Court, which had also found in favour of Mr Fava, still stands and the Superintendent of Public Health has been ordered to grant a temporary license to operate a pharmacy within 7 days from today, for a pharmacy in 20/21 Republic Street, Valletta in terms of Art 72B of the Medicines Act. In the event that such license is not issued within the peremptory period of seven days, Chemimart Limited are authorised to operate a pharmacy from the premises 20/21 Republic Street, Valletta.
Decrees were also given in the Warrants of Prohibitory Injunctions filed by Collis Williams et and the GRTU not to issue a license to Chemimart Limited to operate a pharmacy from 20/21 Republic Street, Valletta, wherein same Prohibitory Injunctions were refused.
