New amendments dealing with Personal Injurty claims discussed

A proposal for the amendment of personal injury claims is curently being debated and will soon be open for consultation.
The present system is one largely based on case-law following the principle used in Butler v Heard (1967) and the principles and equations arising therefrom. This proposed system seeks to address any inconsistencies, one of which is capping the total of compensation resulting from accidents to €600,000. The proposal also lists the different losses and injuries one may sustain, and the percentage of disability that would translate to.
The percentage of disability, the person's age, income, and other factors are worked into a formula to determine the amount of damages due. However, the Courts do keep a degree of discretion.
