Trade Marks
Trade marks are marks or symbols used to distinguish between products and services used in trade. It is the name by which consumers come to know and recognise one’s product/service. The trade mark is clearly, therefore, an essential asset to one’s business.
At Fenech & Fenech we understand the vital role trade marks play in a business’ life, and are able to provide expert advice every step of the way: from planning your trade mark strategy, to registering your trade mark in the jurisdiction of your choice, portfolio management, defending your mark, and advising on any claims or infringement which might arise.
We also understand that as consumer education changes clients may wish to register their different and non-traditional trade marks: slogans, shape marks, audio marks, and olfactory marks. Our trade mark attorneys are able to assist here too.
Malta, as an EU member state, offers a multiplicity of possibilities to businesses when choosing the territories in which to register their marks. IP strategies may be followed through locally, or at an EU-wide level, or even worldwide.
By international consensus it has been agreed that a mark is registered in a specific category of goods or services. The system of classification which is widely adopted is the Nice Classification which lists 45 such classes.
If you would like to register your mark in Malta, or within the EU, or worldwide, please contact our intellectual property department who will be happy to help you formulate the best and most efficient strategy for your mark.
